At a glance45 daysfor an Oklahoma landlord to return the deposit after your written demand (41 O.S. 115)
Key takeaways
  • Ask for your deposit in writing the day you return the keys.
  • The landlord then has 45 days to return it, less itemized deductions.
  • No written demand within 6 months can mean losing the deposit.
  • Oklahoma sets no cap on deposit size.
  • Blinds, fans, red dirt and the garage are what Oklahoma City landlords check.

Oklahoma’s security deposit law has one rule that catches many renters out: the landlord’s 45-day deadline only starts once you have moved out, handed back possession and asked for the deposit in writing, and if you never make that written demand within 6 months, the deposit can be lost for good. This guide explains the rules in plain English, what an Oklahoma landlord can deduct, and how to leave a rental in Oklahoma City, Edmond or Norman so cleaning costs you nothing.

Oklahoma deposit rules at a glance

  • Statute: 41 O.S. 115, part of the Oklahoma Residential Landlord and Tenant Act
  • Deposit cap: none set by state law; the lease sets the amount
  • Where it is held: in an escrow account at a federally insured institution in Oklahoma
  • Written demand: you must ask for the deposit in writing after you move out
  • Return deadline: within 45 days after the tenancy ends, possession is delivered and you make the written demand
  • Deductions: unpaid rent and damage from not meeting the lease or the law, itemized in writing
  • Six-month limit: if you don’t make the written demand within 6 months of the tenancy ending, the deposit can revert to the landlord

This is general information, not legal advice. Laws change, so check the current statute or ask a legal aid office about your situation.

The written demand: do it the day you leave

The single most useful thing an Oklahoma renter can do at move-out is send a written demand for the deposit, with a forwarding address, as soon as the keys are returned. A short letter or email is enough: your name, the rental address, the date you moved out and returned the keys, a request for the deposit and an itemized statement of any deductions, and the address where the money should be sent. Keep a dated copy. That letter starts the 45-day clock and protects you from the 6-month forfeiture rule.

How deductions must be itemized

If the landlord keeps any part of the deposit, the deductions must be itemized in a written statement, delivered by certified mail with a return receipt or handed to you in person if you can reasonably be found. Check each item against your move-in photos and the lease. A deduction for “cleaning” with no detail is worth questioning; a specific charge for an oven left greasy, with a price, is the kind of thing the law expects.

What can and cannot be deducted

An Oklahoma landlord can apply the deposit to unpaid rent and to damage caused by your failure to meet the lease or the law. Ordinary wear and tear is not damage.

How common move-out problems are usually treated
What the landlord findsUsually
Faded paint, light scuffsOrdinary wear and tear
Small nail holesOrdinary wear and tear
Carpet worn in walkwaysOrdinary wear and tear
Greasy oven, dirty fridge, soap scumChargeable cleaning if it was clean at move-in
Red clay ground into carpetOften charged as carpet cleaning
Pet stains and odorChargeable
Belongings or trash left in the garage or shelterChargeable removal

Protect the deposit from the day you move in

Oklahoma law doesn’t require a joint move-in inspection, so make your own record. Walk every room with your phone on the first day, take dated photos and a short video, and open the oven, fridge, dishwasher, cabinets and closets. Note anything already dirty or damaged, including red clay stains in carpet, dusty blinds and marks on walls. Email the list and a few photos to the landlord in the first week and keep the reply.

What Oklahoma City landlords look at

  • The kitchen: inside the oven, fridge, microwave and cabinets, and the range hood
  • Bathrooms: tubs, showers, glass and grout
  • Blinds, ceiling fans, window tracks and vents, where wind-blown dust collects
  • Entry carpet and grout, where red dirt settles
  • The garage and any storm shelter or safe room, which should be swept and empty

Students in Norman and Edmond, families at Tinker

Many leases near the University of Oklahoma and the University of Central Oklahoma end in May, so cleaning slots fill up fast around the end of the semester; book two or three weeks ahead and agree with roommates in writing who cleans which room and how the deposit is split. Military families moving to or from Tinker Air Force Base often have fixed report dates. The Servicemembers Civil Relief Act lets service members end a lease early in certain situations with proper notice; ask your installation’s legal office how it applies, and book the clean for the day after the movers.

Your own move-out photos

Oklahoma law does not require landlords to take move-out photos, so your own record matters as much at the end as at the start. On the day the clean is finished, walk the home in the same order as your move-in photos: wide shots of each room first, then close-ups of the oven, fridge, tub and shower, blinds, ceiling fans, carpets and the garage floor. Ask the landlord to walk through with you if possible, and note in writing anything you disagree with on the day. Keep the photos with your lease, your written demand and the landlord’s reply until the deposit is settled.

What “clean” means at move-out

The standard is the condition you received the home in, less ordinary wear and tear. In practice, Oklahoma City landlords expect the kitchen wiped inside and out, appliances clean, bathrooms descaled and sanitized, blinds and fans dusted, floors vacuumed and mopped, closets and cabinets empty and wiped, and nothing left in the garage, shelter or yard. A professional move-out clean works to that list, and your photos afterward show it was done.

Roommates, pets and leaving early

On a shared lease the deposit usually covers the whole unit, so agree in writing who cleans which rooms and how any refund is split, and decide who sends the written demand. Pet stains, chewed trim and odor beyond ordinary wear and tear can be deducted, so treat red-dirt paw prints and pet hair before the inspection. If you leave before the lease ends, rent owed under the lease can come out of the deposit; talk to the landlord first and get any agreement in writing.

If your deposit isn’t returned

If 45 days pass after your written demand with no refund or itemized statement, write again, citing 41 O.S. 115 and the date of your first letter. Small claims court in your county handles most deposit disputes without a lawyer. Legal Aid Services of Oklahoma has free information for renters, and misusing a tenant’s deposit can carry criminal penalties under the statute.

A move-out plan that protects your deposit

  • Two to three weeks out: find your move-in photos and lease, and book your clean
  • The day before: defrost and empty the fridge and freezer
  • Moving day: remove everything, including the garage, shelter and storage
  • Cleaning day: kitchen, bathrooms, blinds, fans, tracks and floors, then photograph each room
  • Key return: send your written demand with your forwarding address the same day
