West Virginia Security Deposit Law (2026): The 60-Day and 45-Day Deadlines, Deductions and Move-Out Cleaning
The 60-day and 45-day deadlines, the itemized list, what counts as wear and tear, and how to move out of a West Virginia rental so the deposit comes back.
- The deadline is 60 days after the tenancy ends or 45 days after a new tenant moves in, whichever is sooner.
- Any amount kept must be itemized in writing.
- Reasonable wear and tear cannot be deducted.
- Willful or bad-faith withholding can cost a landlord up to one and a half times the amount kept, on top of the deposit.
- West Virginia does not require a move-in checklist, so make your own photo record.
West Virginia gives landlords longer than most states to return a security deposit: up to 60 days after the tenancy ends, or 45 days after a new tenant moves in if that comes first. The deposit has to come back with an itemized list of anything kept, and a landlord who withholds money willfully or in bad faith can owe more than the deposit. This guide explains the rules in plain English, what cleaning can be charged, and how to leave a West Virginia rental so the deposit comes back in full. It is general information, not legal advice; laws change, so check the current statute.

The 60-day and 45-day deadlines
The deadline is the sooner of two dates: 60 days after your tenancy ends, or 45 days after the next tenant moves in. In a busy rental market, such as a college town in August, the 45-day date can come first. The landlord sends the deposit and the itemized list to your forwarding address or last known address, so give a forwarding address in writing on or before moving day and keep a copy.
If the landlord cannot reach you by mail and cannot deliver it in person, the law has a fallback: the landlord holds the deposit for a period and makes it available when you ask in writing. Keeping your forwarding address current avoids all of that.
Reasonable wear and tear
A landlord can deduct for damage, but not for reasonable wear and tear. The difference matters in older West Virginia homes, where floors, trim and fixtures may already be decades old.
- Usually wear and tear: faded paint, light scuffs, worn carpet in walkways, small nail holes, loose door handles and old fixtures that stopped working through age
- Usually chargeable: holes, burns, pet damage, broken windows, stains, and dirt and grease well beyond everyday living
What cleaning can be charged
The law does not list cleaning tasks one by one, so most disputes come down to what is reasonable and what the lease says. A greasy oven, a fridge left with food or mold, bathrooms with heavy soap scum or mildew, trash or belongings left behind, and pet hair and odors are commonly charged. Light dust in a home you cleaned before leaving should not be. Ask for the itemized list to show what was cleaned and what it cost.
Humidity matters here. A fridge switched off and shut, or a basement left damp, can grow mildew within days in a West Virginia summer. Leave the fridge running or propped open, and run the AC or a dehumidifier until the walk-through.
Pet deposits and fees
Many leases add a pet deposit or a pet fee. A refundable pet deposit is part of the security deposit and follows the same deadlines and itemized-list rule. A fee the lease clearly describes as non-refundable is usually separate. Read the lease before you sign, keep a copy, and make sure pet hair, litter and yard waste are gone before the walk-through.
Utilities and unpaid bills
West Virginia allows a landlord to deduct utility charges you owed that the landlord had to pay. Before you leave, read the final meters, arrange final bills in your name, and keep the receipts. That removes one of the most common surprises on an itemized list.
Your own record: photos and a checklist
West Virginia does not require a move-in checklist, so make your own. On move-in day, take dated photos and a slow video of every room, including inside the oven, fridge, cabinets and closets, the bathroom grout and the basement. Write down any existing damage, ask the landlord to sign or acknowledge it, and keep a copy. At move-out, repeat the photos from the same angles once the home is empty and cleaned. Side-by-side photos settle most cleaning disputes quickly.
Students in Morgantown and Huntington
Student leases often end in May, and many are shared, with one deposit for the whole house. Agree among housemates who books the move-out clean and how the deposit will be split, and make sure everyone gives a forwarding address. Clean shared spaces, the kitchen, bathrooms and basement, first, because those are where most deductions come from.
The final walk-through
West Virginia law does not require a joint move-out inspection, but asking for one is still wise. Walk through with the landlord on the last day, bring your move-in photos, and ask whether anything would be deducted while there is still time to fix it. If the landlord cannot attend, take your own photos and video and email them the same day, together with your forwarding address. Hand back every key, garage remote and mailbox key, and note the date in writing.
If the rental is sold
When a rental changes hands, ask the old landlord in writing who now holds your deposit, and keep the reply with your lease. The same deadlines then apply to whoever holds it when you move out.
If your deposit isn’t returned
- Write to the landlord, quoting W. Va. Code § 37-6A-2 and giving your forwarding address
- Ask for the itemized list and any contractor invoices behind each charge
- Send your move-in and move-out photos with the letter
- If that fails, magistrate court handles most deposit claims in West Virginia; check the current claim limit
- Legal Aid of West Virginia helps eligible tenants with housing problems
A move-out plan that protects your deposit
- Three weeks out: find your lease and move-in photos, and ask for a cleaning quote
- One week out: give your forwarding address in writing and ask for a walk-through
- The day before: defrost and empty the freezer, and take trash and bulky items away
- Moving day: remove everything, including the basement, attic, garage and porch
- Cleaning day: kitchen and appliances, bathrooms free of mildew, sills, baseboards and floors, then photograph each room
- Walk-through: bring your photos and hand back every key
