Key takeaways
  • A Rhode Island deposit can’t exceed one month’s rent.
  • The 20-day deadline runs from the latest of move-out, return of possession and your forwarding address.
  • Reasonable cleaning and trash removal costs can be deducted.
  • Wrongful withholding can cost a landlord twice the amount withheld.
  • Photograph the unit at move-in and move-out.

Rhode Island’s security deposit law is short, and it differs from its neighbors in one important way: a landlord may deduct reasonable cleaning costs. That makes the condition you leave a rental in matter directly to your refund. This guide explains the rules in plain English and gives a move-out plan that protects your money. It is general information, not legal advice; check the current statute (Rhode Island General Laws §34-18-19) or ask a lawyer about your own case.

Rhode Island deposit rules at a glance

  • Cap: a deposit can’t be more than one month’s rent
  • Furnished units: where the furnishings are worth at least $5,000, a separate furniture deposit of up to one month’s rent may be allowed
  • Return deadline: 20 days after the latest of the end of the tenancy, the return of possession and your forwarding address
  • Itemized list: any deduction must be listed in writing, with the balance returned
  • Allowed deductions: unpaid rent, reasonable cleaning and trash removal, and physical damage beyond ordinary wear and tear
  • Penalty: if the landlord does not comply, you may recover the amount due plus damages of twice the amount wrongfully withheld and reasonable attorney’s fees

When the 20-day clock starts

The deadline runs from the latest of three things: the end of the tenancy, the day you hand back possession (usually the keys) and the day the landlord receives your forwarding address. If you move out on the 31st but only send your new address on the 10th, the clock starts on the 10th. Send it in writing before you leave and keep proof.

Cleaning can be deducted

In Massachusetts, cleaning fees cannot come out of a deposit. Rhode Island is different: the statute allows a landlord to deduct reasonable cleaning expenses and reasonable trash disposal expenses. The word that matters is “reasonable.” A landlord should not charge a full professional clean for a unit left in good order, and cannot charge for ordinary wear and tear. But an oven caked in grease, a fridge left full, bathrooms that need scrubbing or bags of trash in the basement can lead to legitimate deductions.

The simplest protection is to leave the unit as clean as you found it, remove every item and bag of trash, and photograph the result.

Wear and tear versus deductions

Typical Rhode Island move-out items
Usually wear and tearCan lead to a deduction
Lightly scuffed or faded paintHoles, marker or unapproved paint
Worn carpet in walkwaysBurns, pet stains or tears
Light dust after moving outGreasy oven, dirty fridge, unscrubbed bathroom
Loose door handlesBroken doors, windows or screens
Small picture-hook holesFurniture or trash left behind

Protect yourself from move-in day

Rhode Island does not require a move-in checklist, so your own record matters. On the day you get the keys, take dated photos and video of every room: inside the oven, fridge and cabinets, bathroom grout and fixtures, floors, walls, windows, screens, radiators, the porch and the basement storage area. Email the landlord a short list of existing problems and keep the reply. If the unit was not clean when you moved in, say so in writing then, because that is the standard your move-out will be compared with.

Older units and lead

Much of the rental housing in Pawtucket, Central Falls and Woonsocket was built before 1978. Rhode Island’s lead hazard laws require owners of most older rental units to meet lead-safe standards and hold a certificate. As a tenant, report peeling or chipping paint in writing rather than scraping or cleaning it yourself, and do not let a move-out clean include sanding or scraping paint.

A move-out plan that protects your deposit

  • Three weeks out: book the move-out clean for the day after the movers, and ask the landlord for a walk-through
  • Two weeks out: send your forwarding address in writing
  • The week before: arrange bulky-item pickup with your city for furniture and mattresses you are not taking
  • The day before: defrost and empty the fridge and freezer
  • Moving day: remove everything, including the basement, porch, yard and any shared storage
  • Cleaning day: kitchen and appliances, bathrooms, radiators, sills and floors, then photograph each room
  • Keys: return them in a way you can prove, and note the date

Trash, mattresses and bulky items

Because Rhode Island allows trash removal costs to be deducted, leaving furniture, mattresses or bags in the basement can cost you. Cities in the Blackstone Valley run bulky-item collection, usually by appointment, and Rhode Island has a mattress recycling program with drop-off sites. Paint, chemicals and batteries go to the state’s household hazardous waste program. Plan these a week or two ahead of moving day.

Writing the forwarding-address letter

Keep it short: your name, the rental address, the date you moved out and returned the keys, your new mailing address, and a request that the deposit be returned under §34-18-19. Send it by email and by mail, or by certified mail, and keep a copy. If your address changes again before the refund arrives, send an update the same way.

What Rhode Island landlords check first

Because cleaning can be deducted, it helps to know where landlords look. In most older Blackstone Valley units the list is the same: the oven and stovetop, the inside of the fridge, bathroom grout, tub and toilet, kitchen cabinets inside, radiators and window sills, floors, and anything left in the basement, porch or yard. A move-out clean that covers those, followed by your own photos, removes most of the room for argument.

Roommates and shared leases

When several people sign one lease, the landlord usually returns one deposit for the whole unit and makes one set of deductions. Agree in advance how the refund will be split and who is responsible for which rooms. The fairest approach is often a single professional move-out clean booked for after the last roommate leaves, with the cost shared.

Don’t use the deposit as last month’s rent

It is tempting to skip the last month’s rent and tell the landlord to keep the deposit. That usually backfires: the deposit is then used for rent, leaving nothing to cover cleaning or damage, and the landlord can still pursue you for those costs. Pay the final month and let the deposit come back to you.

If your deposit isn’t returned

If 20 days have passed since the latest of the three trigger dates, write to the landlord with the date you moved out, your forwarding address and the amount owed, and cite §34-18-19. Keep copies. If that fails, small claims court handles most deposit disputes, and the statute allows damages of twice the amount wrongfully withheld plus reasonable attorney’s fees. Rhode Island legal aid organizations can help with letters and next steps.
