How to get your full security deposit back in Atlanta (2026)
Georgia law gives Atlanta renters real protections on their deposit. Here is how the rules work, how to clean for the inspection, and what to do if money is withheld.
- Georgia landlords must return the deposit, or the balance with a written statement of reasons, within 30 days after obtaining possession of the unit.
- You should receive a signed list of existing damage before paying the deposit, and the landlord must inspect and list any damage within three business days after you vacate.
- A landlord cannot keep any part of the deposit for normal wear and tear, and for leases entered or renewed on or after July 1, 2024, deposits are capped at two months' rent.
- Dispute any item on the move-out list specifically and in writing, because later claims are limited to items you dissented from.
- Wrongful withholding by a covered landlord can cost three times the amount plus attorney's fees, and Georgia magistrate courts hear claims up to $15,000 without a lawyer.
- Across 43 metro Atlanta jobs that included move-out cleaning in 2026, the median whole-job total was $516.
In Georgia, your landlord has 30 days after taking back possession of the unit to return your security deposit, or to send a written statement of exactly why any part was kept, and cannot deduct for ordinary wear and tear (O.C.G.A. § 44-7-34). Atlanta renters who get the whole amount back usually do three things: document the unit at move-in, leave it clean enough that the move-out damage list is empty, and dispute anything they disagree with in writing.
This guide covers what Georgia's deposit law actually requires, how to tell wear from damage, a move-out cleaning plan, what Atlanta landlords tend to check, and what to do if money is withheld. It is general information, not legal advice.
What Georgia law says, in plain terms
Georgia's security deposit rules sit in O.C.G.A. §§ 44-7-30 to 44-7-37. The core requirements, as they read in the 2025 Code of Georgia:
| Rule | What it means for you | Code section |
|---|---|---|
| Deposit cap | No more than two months' rent, for leases entered or renewed on or after July 1, 2024 | § 44-7-30.1 |
| Escrow | The deposit goes in a separate escrow account, and you must be told in writing where it is held | § 44-7-31 |
| Move-in list | Before you pay the deposit, you get a comprehensive move-in list of existing damage, may inspect the unit to check it, and both of you sign it | § 44-7-33(a) |
| Move-out inspection | Within three business days after the lease ends and you vacate, the landlord inspects and writes a move-out damage list of any damage with an estimated dollar value; you may inspect the unit and the list within five business days | § 44-7-33(b) |
| Return deadline | Within 30 days after the landlord obtains possession, return the deposit, or the balance with a written itemized statement of the exact reasons for keeping any part, sent first-class to your last known address | § 44-7-34 |
| Penalties | A landlord who skips the required lists or misses the deadline loses the right to withhold anything; wrongful withholding can cost three times the amount plus reasonable attorney's fees, unless it was a bona fide error | § 44-7-35 |
The move-in rule is worth reading in the statute's own words:
"Prior to tendering a security deposit, the tenant shall be presented with a comprehensive list of any existing damage to the premises."
One important exception: under § 44-7-36, an individual who, with a spouse and minor children, owns ten or fewer rental units and manages them without a paid manager is exempt from the escrow, inspection-list and penalty sections. The 30-day return and written-statement requirement in § 44-7-34 still applies. If a property management company collects your rent, the exemption does not apply, which covers many Atlanta apartment communities and professionally managed rental houses.
Normal wear and tear vs damage
Georgia law bars a landlord from keeping any part of the deposit for normal wear and tear from ordinary use, unless it resulted from negligence, carelessness, an accident or abuse by you, your household or guests. Allowed deductions include unpaid rent and late fees, unpaid utilities, unpaid pet fees and actual damage. Common examples of how the line is usually drawn:
| Usually wear and tear | Usually damage |
|---|---|
| Paint faded by sun, light scuffs along hallways | Large holes, crayon or marker on walls, unapproved paint colors |
| Carpet worn in walkways after years of use | Pet urine stains, burns, rips, heavy red-clay staining |
| Loose door handles, minor grout discoloration from age | Broken blinds, cracked tiles, missing fixtures |
| Light dust after furniture is moved out | Baked-on oven grease, mold from neglect, trash left behind |
Cleaning sits in a gray zone. The statute does not list a general cleaning fee as a deduction, but heavy dirt, grease or pet mess is often itemized as damage, and many Atlanta leases spell out the condition the unit must be left in. Read your lease's move-out clause before you plan the clean.
A move-out cleaning plan that works backward from the inspection
The landlord has three business days after you vacate to build the damage list, so the unit needs to be finished, not half-done, when you hand back the keys.
- Two to three weeks out: find your signed move-in list and photos, reread the lease's cleaning and carpet clauses, and book any help you need. Summer is the busy season: our metro Atlanta jobs peaked in July (22) and August (18).
- One week out: report anything broken in writing, defrost the freezer, and use up food so the fridge can be emptied.
- After the furniture leaves: clean top to bottom, room by room. Dust and wipe ceiling fans, vents and light fixtures first; then walls, switches and baseboards; then cabinets, appliances and bathrooms; floors last.
- Before you lock up: walk through with your phone and take date-stamped photos and video of every room, inside appliances and closets.
- At handover: return every key, fob and remote, and give your forwarding address in writing.

What Atlanta landlords commonly check
Inspections tend to focus on the same places, and they line up with the add-ons Atlanta renters book most. Across our 99 metro Atlanta jobs, 46 included appliances cleaned inside and out, 35 walls and ceilings, 28 deep carpet cleaning and 12 pet hair removal.
- Kitchen appliances: inside the oven, the drip pans, inside the fridge and freezer, the range hood filter.
- Cabinets and drawers: crumbs, grease on fronts, shelf liners removed.
- Bathrooms: soap scum, grout, hard-water film, the exhaust fan cover.
- Carpet: stains, odor and tracked-in red clay, especially near entry doors.
- Walls and baseboards: scuffs, nail holes beyond what the lease allows, dust.
- Windows: sills, tracks and blinds, which collect spring pollen.
- Balconies and patios: pollen film, dirt and anything left behind.
- Odds and ends: HVAC filter, light bulbs, smoke detectors in place, trash removed.
What a move-out clean costs in metro Atlanta
Across 43 metro Atlanta jobs that included move-out cleaning in 2026, the median whole-job total was $516, add-ons included.
| Home size | Jobs | Median total | Range we saw |
|---|---|---|---|
| 1 bedroom | 6 | $232 | $215 to $392 |
| 2 bedrooms | 8 | $469 | $245 to $545 |
| 3 bedrooms | 10 | $600 | $414 to $996 |
| 4 bedrooms | 10 | $595 | $454 to $952 |
| 5+ bedrooms | 5 | $1,108 | $802 to $1,401 |
The samples are small, so treat these as a guide. Against a deposit that can now be as much as two months' rent, a professional clean is often the cheaper side of the bet, especially if your lease requires professional carpet cleaning anyway.
If your landlord keeps money you think is yours
- Check the clock. Note when you returned the keys. If 30 days pass with no refund and no written statement, a covered landlord has forfeited the right to withhold under § 44-7-35.
- Inspect and dissent in writing. Ask to see the unit and the move-out list within five business days. If you disagree, write down each disputed item specifically and sign it. Under § 44-7-33(c), a later claim is limited to the items you dissented from.
- Send a demand letter. Cite the statute, attach your photos and the move-in list, state the amount, and give a reasonable deadline. Keep a copy and proof of mailing.
- File in magistrate court. Georgia's magistrate court system hears civil claims up to $15,000, and neither side needs a lawyer. Fulton, DeKalb, Cobb, Gwinnett and every other county have one; Georgia's Department of Community Affairs handbook notes you can sue where the landlord resides.
- Know the remedy. If the court finds wrongful withholding by a covered landlord, you can recover up to three times the amount plus reasonable attorney's fees.
